Rental Agreement & Liability Waiver

By renting and using an electric bicycle (“e-bike”) from this business, you (“Customer”) agree to the following terms and conditions:

1. Assumption of Risk

You understand and acknowledge that riding an electric bicycle involves inherent risks, including but not limited to:

Loss of control
Collisions with vehicles, pedestrians, or objects
Road hazards and uneven surfaces
Mechanical failure
Serious injury or death

You voluntarily assume all risks associated with the use of the e-bike, whether known or unknown, and accept full responsibility for any resulting injury, damage, or loss.

2. Rider Responsibility

You agree to:

Operate the e-bike in a safe and responsible manner
Follow all local, state, and traffic laws
Ride only in appropriate and permitted areas
Not operate the e-bike under the influence of drugs, alcohol, or any impairing substances
Use appropriate safety precautions at all times

You are fully responsible for any individual using the rented equipment under your reservation, including friends, family members, or minors.

3. Age & Supervision

Riders must be at least 18 years of age, or supervised by a responsible adult
You accept full responsibility for any minor using the equipment under your rental

4. Condition of Equipment

You acknowledge that:

The e-bike is provided in working condition
You have had the opportunity to inspect the equipment upon delivery

You agree to:

Notify us immediately of any damage, malfunction, or issue
Discontinue use if the bike appears unsafe

Continued use of the bike constitutes acceptance of its condition.

5. Proper Use of Equipment

You agree NOT to:

Use the e-bike for racing, stunts, or off-road use (unless clearly permitted)
Modify or tamper with the bike
Sublease or transfer the rental to another party
Use the bike in a negligent or reckless manner

Improper use may result in additional charges or termination of the rental.

6. Damage, Loss, or Theft

You are fully responsible for the care of the e-bike during the rental period.

You agree to pay for:

Any damage beyond normal wear and tear
Theft or loss of the bike
Missing or damaged components (battery, charger, locks, etc.)

Repair or replacement costs may be charged up to the full retail value of the equipment.

7. Delivery & Pickup

Bikes will be delivered to the address provided at booking
You are responsible for ensuring the location is accessible and safe for delivery
Bikes must be available and accessible at the agreed pickup time

Failure to comply may result in:

Additional fees
Delayed pickup charges
Continued rental charges

8. Rental Period

The rental period begins at delivery and ends at scheduled pickup
Late returns or inaccessible bikes may result in additional charges

9. No Liability

To the fullest extent permitted by law, we are not liable for:

Personal injury or death
Property damage
Losses resulting from use or misuse of the equipment

This applies regardless of cause, including negligence.

10. Indemnification

You agree to indemnify, defend, and hold harmless the business, its owners, employees, and contractors from any claims, damages, liabilities, or expenses arising from:

Your use of the equipment
Any injury or damage caused during your rental period
Any breach of this agreement

11. Weather & Conditions

You acknowledge that:

Weather and road conditions may affect safety
Rentals are not refunded due to weather

You accept responsibility for choosing to ride under current conditions.

12. Right to Refuse Service

We reserve the right to refuse or terminate a rental if:

Safety concerns arise
Terms are violated
Misuse of equipment is suspected

13. Agreement & Acceptance

By completing your booking and/or using the rented equipment, you confirm that:

You have read and understood this agreement
You accept all terms and conditions
You agree to be legally bound by this waiver
